Digital Archive Ownership  

By accessing or using the Fredericksburg History Archive, you agree to comply with and be bound by the following terms and conditions of use. Please read these terms carefully before accessing or using our platform.   

The Fredericksburg History Archive may partner with outside organizations (also referred to as “associates”) to create “Special Projects”. These projects are listed under the “Special Projects” tag. The Terms and Conditions apply to these affiliates as well. 

All content, including text, images, documents, audio, video, and any other materials uploaded or stored within this archive is the property of the Fredericksburg History Archive unless otherwise stated.  

Users retain any copyright ownership they may have in their original contributions. However, by uploading content to the Fredericksburg History Archive, users grant the archive and the Fredericksburg Area Museum and its associates a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content worldwide in any form, media, or technology, for any commercial use or otherwise. 

Your Submission may remain in the Fredericksburg History Archive indefinitely, even if not actively displayed or used in ongoing promotional efforts.

The Fredericksburg History Archive has the right to use discretion in deciding whether to display or use images, documents, and recordings.  

The archive does not have an obligation to accept every submission.  

The Fredericksburg History Archive and its associates reserve the right to edit or adapt the Submission for clarity, style, or format while maintaining the integrity of your original submission. 

We may contact you for additional information.  

Images may be removed from the archive without the requirement of contacting the contributor.  

The Fredericksburg History Archive will give credit to the contributor when publicly displaying the item. 

Permissions  

Permission must be obtained from the Fredericksburg History Archive for any use of the content stored within the archive beyond personal, non-commercial purposes.  

Users seeking permission to use content from the Fredericksburg History Archive for commercial, educational, research, or any other purposes must submit a request through this link or collections@famva.org 

The Fredericksburg History Archive reserves the right to grant or deny permission for the use of content at its sole discretion.  

Permission granted for content use may be subject to specific conditions, including proper attribution, usage limitations, and fees.   

If your submission contains images with identifiable individuals, you confirm that you have obtained all necessary consents and permissions to use and share those images publicly. 

Copyright and Intellectual Property  

Users are responsible for ensuring that any content they provide to the Fredericksburg History Archive does not infringe upon the copyrights or intellectual property rights, privacy rights, or any other legal rights of any third party. 

The Fredericksburg History Archive will not knowingly publish copyrighted material.  

Enforcement of Terms  

The Fredericksburg History Archive reserves the right to suspend or terminate access to the platform for users who violate these terms and conditions.  

Modifications to Terms  

The Fredericksburg History Archive and its associates reserve the right to modify these terms and conditions at any time without prior notice.  The most current version of the terms will be available on our website. 

Continued participation in any associated “Special Projects” constitutes acceptance of any changes. 

Users are responsible for regularly reviewing these terms and conditions to stay informed of any changes.
